Real Estate Contracts and Disputes

Areas of Practice in Real Estate

Whether you buy or sell real estate (or both), it’s important to always use well-written, loophole-free contracts to facilitate transactions. Real estate can be extraordinarily profitable and each contract moves a substantial sum of money around. As a result, real estate investors and traders can’t afford to sign contracts that allow for potential breaches or legal issues.

Kaminsky Law’s attorneys are well-equipped to help you facilitate profitable real estate deals, as well as ensure that all your real estate contracts are accurate and consider potential pitfalls.

Real Estate Contracts

Legal contracts must always be precise in their wording and leave nothing to chance, especially when it comes to real estate sales agreements and other documents. With the right legal contract, you can be more confident in the transaction and protect yourself from legal action from a buyer or seller.

At Kaminsky Law, we have the knowledge necessary to draft any type of real estate contract you may require. We can also assist with the following real estate law areas.

Commercial Leases

Commercial leases often deal with property worth well into the millions or billions of dollars. With specific business needs, buildouts, and other types of issues, it pays to have a lawyer review the terms before you sign. Contact Kaminsky Law and we’ll help draft rock-solid lease agreements for commercial properties or advise your business before signing a long-term commercial lease.

Enforcement of Real Estate Sale Agreements

If a real estate sales agreement was signed, but the buyer or seller backs out, you can contact Kaminsky Law. We can assist with enforcing real estate sale agreements in the Philadelphia, Bucks County, and Montgomery County areas if the seller refuses to sell or isn’t upholding their end of the bargain.

Real estate contracts are binding agreements, and because real estate is considered a “one of one” piece of property, courts will often enforce specific performance for the sale of a piece of real estate. Whether it is a breach of the agreement, lost deposit, or complete refusal to sell, if a party does not agree to go through the sale, we can help you pursue legal action to recover your losses or the property in question or force the transaction through.

Lis Pendens

A Lis Pendens is an official Notice of Pending Action, effectively announcing to any potential third-party buyers that a lawsuit has been filed concerning a piece of property or real estate. If you have a claim of ownership interest or the title in the property, and want to ensure that the property doesn’t get sold to someone else while its resolved, a Lis Pendens may be the necessary course of action.

Kaminsky Law can assist with both drafting a lawsuit and putting a Lis Pendens on the property to prevent it being sold while the lawsuit is resolve. Similarly, we can defend against an improperly filed Lis Pendens if someone has sued you improperly.
